Tokita Seed America is committed to your success, every step of the way. We want you, our customer, to be 100% satisfied with all of our seeds, tools, and supplies. If anything you purchase from us proves unsatisfactory, we will either replace the item or refund the purchase price.

No other express guarantee or warranty is made in respect thereof.

EXCLUSIVE LIMITATION OF REMEDY FOR COMMERCIAL CUSTOMERS

The liability of Tokita Seed America for breach of guarantee (warranty), or for any loss or damage arising out of the purchase or use of its seeds or other products, including loss or damage resulting from negligence or strict liability in tort, shall be limited to replacement of the dissatisfactory item or refund of the purchase price.

Nor shall Tokita Seed America be liable for any incidental or consequential loss or damage, including any loss or damage resulting from negligence or strict liability in tort.

NOTE

Claims for defects in Tokita Seed America’s products must be presented to Tokita Seed America as soon as practicable and, in any event, within 30 days of discovery.

Tokita Seed America does not accept responsibility for product losses caused by extreme weather, neglect, or for products grown in a zone/climate that is conflicting to what Tokita Seed America recommends.
